Terms and Conditions

These Terms and Conditions (“Terms”) govern your purchase of and access to The Small Key Protocol course, related digital materials, community access, and any related services (collectively, the “Services”) offered by H Drive LLC, doing business as The Small Key Protocol (“we,” “us,” or “our”). By purchasing, accessing, or using the Services, you agree to these Terms.

1. Eligibility and Acceptance

You represent that you are at least the age of majority where you live and are legally able to enter into this agreement. If you purchase or access the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Educational Purpose Only

The Services provide marketing education, strategy, templates, and implementation guidance. They are not legal, financial, tax, accounting, or business-management advice. You are solely responsible for your business decisions, advertising claims, customer communications, account configuration, legal compliance, and the way you use any information in the Services.

3. No Earnings or Results Guarantee

Results vary based on your market, offer, budget, sales process, implementation, responsiveness, platform policies, competition, and other factors outside our control. We do not promise a specific number of leads, appointments, customers, sales, revenue, return on ad spend, or business outcome. Any examples, testimonials, or case studies are individual experiences and do not guarantee that you will achieve the same or similar results.

4. Course Access and Accounts

After successful payment, we will provide access to the course or member area using the email address supplied at checkout. You must keep your login credentials confidential and may not share, resell, transfer, reproduce, or distribute course access or materials. You are responsible for activity under your account.

5. Payment, Pricing, and Taxes

The Small Key Protocol is offered as a one-time purchase of USD $280, unless a different price is clearly shown at checkout. Payment is processed by our third-party payment processor. You authorize us and the payment processor to charge the payment method you submit. You are responsible for applicable taxes, fees, and currency-conversion charges associated with your purchase.

6. 30-Day Money-Back Guarantee

We offer a 30-day money-back guarantee for the core course purchase. To request a refund, contact us at [email protected] within 30 calendar days of your purchase date and include the email address used at checkout. Refund requests made after the 30-day period are not eligible. Refunds apply only to the course purchase price actually paid and do not include third-party software, advertising spend, payment-processing fees, or purchases made from any third party.

Where the sales page or checkout states that the guarantee is “no questions asked,” we will honor a timely request without requiring a written explanation. This guarantee does not promise any business result and does not alter your responsibility for advertising spend or third-party services.

7. Optional Community and Additional Offers

We may offer optional community access, coaching, workshops, bonus programs, or additional digital products. Any separate offer will display its own price, billing terms, and cancellation instructions before payment. Unless expressly stated otherwise, optional offers are separate from the core course purchase.

8. Third-Party Platforms and Services

The Services may discuss or link to third-party platforms, including advertising, CRM, payment, analytics, AI, hosting, and communication tools. We do not control those services and are not responsible for their pricing, availability, policies, functionality, account approval, data handling, outages, or results. Your use of third-party services is governed by their own terms and policies.

9. Intellectual Property and Permitted Use

All course content, scripts, frameworks, prompts, templates, videos, graphics, downloads, trademarks, and other materials are owned by us or our licensors and are protected by applicable intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the materials for your own business while you have authorized access.

You may not copy, sell, publish, sublicense, share, scrape, record, modify for resale, or create a competing course or service from our materials without prior written permission.

10. Acceptable Use

You may not use the Services to violate a law, infringe another person’s rights, make false or misleading advertising claims, send unlawful messages, distribute spam, interfere with the Services, attempt unauthorized access, or harm our brand, customers, systems, or community members. We may suspend or terminate access for conduct that we reasonably believe violates these Terms.

11. Disclaimers

The Services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We make no warranty that the Services will be uninterrupted, error-free, suitable for every business, or compatible with every platform or account. We do not guarantee the availability or continued functionality of third-party advertising platforms, payment processors, CRMs, or related tools.

12. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost revenue; loss of data; loss of goodwill; advertising spend; account suspensions; or business interruption arising from or related to the Services. Our total liability for any claim related to the Services will not exceed the amount you paid us for the specific Service giving rise to the claim during the 12 months before the claim.

13. Indemnification

You agree to indemnify and hold us harmless from claims, losses, liabilities, damages, and expenses arising from your use of the Services, your advertising, your business operations, your violation of these Terms, or your violation of a law or third-party right.

14. Changes, Suspension, or Termination

We may update, modify, suspend, or discontinue all or part of the Services when reasonably necessary. We may update these Terms by posting a revised version on this page. Continued use after the effective date of revised Terms constitutes acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Before starting a formal claim, you agree to contact us at [email protected] and attempt to resolve the issue informally for at least 30 days.
